Terms of Service

1. Acceptance of Terms

By accessing or using Swipe Name ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Swipe Name is a web application that helps expecting parents discover and choose baby names. The Service allows users to browse baby names, save favorites, and match preferences with a partner. The Service offers a free tier with a daily swipe allowance, and an optional Premium upgrade purchased as a single one-time payment. Premium is not a subscription and does not renew. Prices are shown before purchase, and all purchases are final and non-refundable — see Section 7.

3. Account Registration

To use certain features of the Service, you must create an account using Google Sign-In or an email address and password. By creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Collect or store personal data about other users without their consent
  • Use automated systems or software to extract data from the Service
  • Impersonate any person or entity

5. Intellectual Property

The Service and its original content, features, and functionality are owned by Swipe Name and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any part of the Service without our prior written consent.

6. User Content

By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process the content you provide (such as name preferences and swipe data) solely for the purpose of providing and improving the Service. You retain ownership of your content.

7. Payments and Refunds

Premium is a one-time purchase, not a subscription. There is no recurring charge and nothing renews. Once purchased, Premium access is tied to your account for the lifetime of the Service.

Payments are processed by Stripe. We do not receive or store your card details. Your use of Stripe's checkout is subject to Stripe's own terms and privacy policy.

Where a partner discount applies, the reduced price is calculated at checkout based on your linked partner's existing Premium purchase. Discount eligibility is determined at the time of purchase and is not applied retroactively to earlier purchases.

Premium is currently offered for sale only to customers in the United States, Canada, Australia and New Zealand. Payments attempted from outside those territories may be declined, and we may change this list at any time. This restriction applies only to purchasing Premium — the free tier is available wherever the Service is accessible.

All purchases are final and non-refundable. Premium unlocks immediately on payment, so by completing checkout you request immediate access to the digital content and acknowledge that the purchase cannot be refunded once that access has been granted. We do not offer refunds for change of mind, for unused access, or because you or your partner stopped using the Service.

You can decide whether Premium is right for you before paying: the free tier lets you browse every name in the catalog, and the features Premium unlocks are listed in full on the pricing page.

We may, entirely at our discretion, reverse a charge in cases such as a duplicate payment, a payment taken in error, or a fault on our side that prevents us from delivering Premium at all. Doing so once does not create any obligation to do so again. Where a payment is reversed — by us, by the payment processor, or through a chargeback — Premium access is removed from the account, and any partner discount claimed against that purchase is withdrawn.

Depending on where you live, you may have statutory rights that override this policy. Nothing in this section limits or removes any right you have under applicable consumer law.

8. Third-Party Services

The Service integrates with third-party services including Google Sign-In for authentication. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF THE BABY NAME DATA PROVIDED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIPE NAME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Termination

We reserve the right to terminate or suspend your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may also delete your account at any time through the app settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
